# Custody

Every physical card you participate in on Market.Cards is securely held in custody by Market.Cards. Custody methods may include, but are not limited to, using third-party professional custodians. Whatever custody method is used, the custody standard will be no lower than the general industry standard. Details, condition, and grading status of each card are disclosed on the corresponding card page. Before participating in any card market, we recommend reviewing the information on that card's market page.

The arrangements above apply to the Phase One "platform-sourced and platform-custodied" model. After Market.Cards opens up to third-party authorized issuance, the specific custody, insurance, and disclosure arrangements may be adjusted accordingly, and the platform will communicate any such changes through the listing rules and announcements.

Intent regarding platform insolvency or wind-down

Market.Cards' intent is for Tokenized Interest holders to have a priority / beneficial interest in the underlying physical cards — meaning that if the platform becomes insolvent or winds down, the relevant physical cards should not be treated as ordinary operating assets of the platform available for distribution to general creditors. Instead, they should be realized through a reasonable path (such as auction), with proceeds distributed pro rata to Tokenized Interest holders based on holdings at the settlement snapshot.

We are working, and will continue to work, toward implementing this through trusts, special purpose vehicles (SPVs), or similar legal structures, so that the arrangement is as bankruptcy-remote as possible under the applicable jurisdiction. The specific arrangement will be disclosed separately as the product matures and as jurisdictional requirements differ. Participants should understand that until a formal legal structure is in place, the arrangement above is the platform's intent and does not constitute an enforceable legal commitment.
